Terms of Service & End User License Agreement

These Terms of Service ("Terms") govern your access to and use of the VibeLink mobile application and related services (collectively, the "Service") operated by Leonard Hawkes ("VibeLink," "we," "us," or "our"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you obtained the Service through the iOS App Store, the End User License Agreement in Section 17 also applies.
If you do not agree to these Terms, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement, have the legal capacity to enter into a binding agreement, and are not barred from receiving the Service under the laws of any applicable jurisdiction.
2. Description of the Service
VibeLink is a music and community platform that includes the following features:
- Link conversion: conversion of music links between Spotify, Apple Music, YouTube Music, SoundCloud, and other supported platforms.
- Profiles and social features: claimable usernames, profile customization, follow relationships, and a discovery feed.
- Events: a listing surface for music events, including optional distribution of promoter-provided discount codes. VibeLink does not sell tickets, collect ticket revenue, or act as an event organizer.
- Partner Perks: standing discount codes provided by third-party partners and made available to eligible users.
- Premium Handles & Reservations: a paid-tier feature that allows eligible users to claim short or curated usernames and to reserve additional handles.
- Gig Board: a community listing service for DJ opportunities. Users may post gig listings and apply to listings posted by others.
Features may be added, removed, or modified at our discretion. Some features are available only to paid subscribers.
3. Accounts and Account Security
To access certain features you may need to claim a username and connect an authentication method. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us at support@getvibelink.com immediately if you suspect unauthorized access.
4. User Content and Conduct
"User Content" means any content you submit, upload, post, or otherwise make available through the Service, including profile information, posts, event listings, perk listings, gig listings, applications, pitches, comments, and messages.
4.1 Your Responsibility
You are solely responsible for your User Content and for any consequences of making it available through the Service. By submitting User Content, you represent and warrant that you have all rights necessary to submit it and that it does not violate these Terms, any applicable law, or the rights of any third party.
4.2 License to VibeLink
You retain ownership of your User Content. By submitting User Content, you grant VibeLink a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify (for formatting purposes only), display, and distribute that User Content as necessary to operate, provide, and improve the Service.
4.3 Prohibited Content and Conduct
You agree not to use the Service to submit, post, distribute, or facilitate any of the following:
- Content that is unlawful, fraudulent, defamatory, obscene, harassing, threatening, or that infringes any intellectual property right.
- Slurs or attacks targeting a person or group based on race, ethnicity, religion, sex, gender identity, sexual orientation, disability, or other protected characteristic.
- Listings or messages that exclude applicants or audiences on the basis of a protected characteristic. For clarity, listings that affirmatively seek participants from a particular community (for example, "seeking female DJs," "queer DJs welcome") are permitted; listings that exclude on the same basis (for example, "no women," "X need not apply") are not.
- Scams, phishing, deceptive solicitations, or listings for illegal venues, unlicensed events, or activities that violate applicable law.
- Spam, repeated bulk solicitations, or attempts to manipulate engagement metrics.
- Attempts to reverse engineer, decompile, scrape, or otherwise interfere with the Service or any user's enjoyment of it.
4.4 Reporting and Moderation
The Service includes a reporting mechanism for User Content. We may, but are not obligated to, review reports and take action, including removing content, suspending or terminating accounts, and revoking premium features or handle reservations. Decisions are at our discretion. Automated screening is applied to certain content fields and may reject submissions; this is not a comprehensive moderation system and does not relieve you of responsibility for compliance with these Terms.
5. Subscriptions and Payments
VibeLink offers optional paid subscriptions and one-time purchases ("Paid Plans"). The current title, term, and price of each Paid Plan are shown in the app at the point of purchase. Paid Plans currently include monthly and annual VibeLink Pro subscriptions, a one-time Lifetime purchase, and a Promoter tier subscription for event organizers.
- Billing: Payment is charged to your Apple ID or Google Play account at confirmation of purchase, and for recurring plans on each renewal.
- Auto-renewal: Recurring subscriptions automatically renew at the end of each term at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period.
- Renewal charge timing: Renewal charges are billed within 24 hours prior to the end of the current period.
- Managing your subscription: Manage and cancel subscriptions through your Apple ID or Google Play account settings.
- Refunds: Payments are non-refundable except where required by law.
- Access on payment failure: Access to paid features may be revoked if payment fails or a chargeback is initiated.
6. Events and Discount Codes
The Service allows promoters and authorized hosts to publish event listings and optionally distribute discount codes redeemable at third-party ticketing platforms (such as Posh, Eventbrite, Partiful, or Luma). VibeLink is not the seller of tickets, does not collect ticket revenue, and is not the organizer or operator of any listed event. All discount codes are provided by the host and redeemed at the host's external platform under that platform's terms. Availability, eligibility, and validity of any code are the responsibility of the host. We make no representation or warranty regarding the accuracy, validity, or availability of any event listing or discount code.
7. Partner Perks
Partner Perks are discount codes or offers from third-party businesses made available to eligible users of the Service. We do not control, endorse, or guarantee any third-party offer. Redemption is governed by the partner's terms and any limitations they impose. Eligibility may depend on subscription tier and is enforced at the point of reveal. We may add, modify, or retire Partner Perks at any time.
8. Premium Handles and Reservations
Certain usernames are designated as "Premium Handles," including handles of three or four characters and a curated list of other handles. Claiming or reserving a Premium Handle requires an active paid subscription, lifetime purchase, or Promoter subscription. You may reserve a limited number of Premium Handles concurrently, as displayed in the app.
Reservations and claims are subject to revocation if the associated content violates these Terms, if the account is terminated, or if the handle reverts to availability under our policies. Specific handles, including those associated with VibeLink branding, are reserved and not claimable. Premium status and handle reservations confer no transferable property right.
9. Gig Board
The Gig Board is a listing service that allows users to post DJ and music gig opportunities and to apply to listings posted by others. VibeLink is a listing and matching platform only. We are not an employer, recruiter, agent, talent agency, or party to any engagement between users.
9.1 No Payment Processing
VibeLink does not process payments, collect compensation, escrow funds, or otherwise act as a payer or payee between users in connection with any gig. All compensation arrangements are negotiated and settled directly between the host and the applicant outside of the Service.
9.2 No Verification of Users or Listings
We do not verify the identity, qualifications, background, or representations of any user, nor the accuracy, legality, or validity of any listing or application. Users are solely responsible for evaluating the suitability and legitimacy of any counterparty before engaging.
9.3 Off-Platform Communication
Communication after an application is filed occurs off the Service via the parties' publicly listed contact methods. We do not relay, monitor, or store such communications.
9.4 Compliance with Employment and Anti-Discrimination Law
Users posting gig listings are solely responsible for compliance with all applicable employment, labor, tax, anti-discrimination, and licensing laws in their jurisdiction. The conduct prohibitions in Section 4.3 apply with full force to Gig Board listings and applications.
9.5 Posting and Application Limits
We enforce limits on the number of active gig postings and active applications per user. Current limits are displayed in the app.
10. Third-Party Service Authentication
Certain features require connecting your account with third-party music services (Spotify, YouTube, Apple Music, SoundCloud). By connecting these services, you authorize us to act on your behalf within the scope of the permissions you grant, including creating playlists and reading basic profile information. We store authentication tokens securely and use them only to perform actions you request.
You may revoke our access at any time through the third-party service's account settings, or by deleting your VibeLink account in Settings → Danger Zone, which deletes all stored tokens. For details on token storage and security, see the Privacy Policy.
By using YouTube integration features, you also agree to the YouTube Terms of Service.
11. Intellectual Property
The Service, including the VibeLink name, logo, designs, software, text, graphics, and other content (excluding User Content), is owned by VibeLink and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, sell, lease, or create derivative works of the Service, in whole or in part, except as expressly permitted by these Terms.
If you believe content on the Service infringes your copyright, contact us at support@getvibelink.com with sufficient information to investigate, including identification of the work, identification of the allegedly infringing material, your contact information, and a statement made in good faith.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
Without limiting the foregoing, VibeLink does not warrant that listings, perks, discount codes, gig opportunities, or third-party integrations will be accurate, available, lawful, or suitable for any purpose. Interactions with other users, third-party platforms, and offline counterparties are at your own risk.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL VIBELINK OR ITS OWNER, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO VIBELINK IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the foregoing limitations apply only to the extent permitted by law.
14. Indemnification
You agree to indemnify, defend, and hold harmless VibeLink and its owner, employees, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your User Content; (b) your use of or interaction with the Service, including any listing posted, application submitted, or arrangement made through the Gig Board; (c) your violation of these Terms; or (d) your violation of any law or the rights of a third party.
15. Termination
You may stop using the Service at any time and may delete your account in the app under Settings → Danger Zone. We may suspend or terminate your access to all or part of the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, third parties, or the Service. Sections that by their nature should survive termination (including Sections 4.2, 11, 12, 13, 14, 17, and 18) will survive.
16. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when the Terms were last revised. Material changes will be communicated through the Service or by other reasonable means. Continued use of the Service after a revision takes effect constitutes acceptance of the updated Terms.
17. End User License Agreement (Apple App Store)
The following terms apply to the Service when downloaded or used on Apple-branded devices via the iOS App Store. They are in addition to, and do not replace, the rest of these Terms. To the extent of any conflict between these Apple-specific terms and the rest of these Terms as applied to App Store downloads, these Apple-specific terms govern.
17.1 Acknowledgment
This Agreement is between you and VibeLink (Leonard Hawkes) only, not with Apple Inc. ("Apple"). VibeLink, not Apple, is solely responsible for the Service and its content.
17.2 Scope of License
The license granted to you for the Service is a limited, non-transferable license to use the Service on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. The Service may be accessed, acquired, and used by other accounts associated with you via Family Sharing or volume purchasing.
17.3 Maintenance and Support
VibeLink is solely responsible for providing any maintenance and support services with respect to the Service. Apple has no obligation whatsoever to furnish any maintenance and support services.
17.4 Warranty
VibeLink is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Service to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the Service.
17.5 Product Claims
VibeLink, not Apple, is responsible for addressing any claims by you or any third party relating to the Service or your possession and use of the Service, including product liability claims, claims that the Service fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
17.6 Intellectual Property Rights
In the event of any third-party claim that the Service or your possession and use of the Service infringes that third party's intellectual property rights, VibeLink, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
17.7 Legal Compliance
You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

17.9 Third-Party Terms
You must comply with applicable third-party terms when using the Service, including the Spotify, YouTube, Apple Music, and SoundCloud terms of service when using related features.
17.10 Third-Party Beneficiary
You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
18. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. The parties consent to the exclusive jurisdiction of the state and federal courts located in New York County, New York for any dispute arising out of or relating to these Terms or the Service, except that VibeLink may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property.
19. Miscellaneous
These Terms, together with the Privacy Policy, constitute the entire agreement between you and VibeLink regarding the Service and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign these Terms freely. Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and VibeLink.
